1. Agreement to Terms
By accessing and using Netalis proxy infrastructure services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Service Description
Netalis provides enterprise-grade proxy infrastructure services including residential proxies, ISP proxies, and mobile proxies. Our services enable secure, anonymous, and scalable web access for enterprise applications.
3. Acceptable Use Policy
3.1 Permitted Uses
You may use our services for lawful purposes including:
- Market research and competitive analysis
- Price monitoring and data aggregation
- Ad verification and brand protection
- Content localization and testing
- SEO monitoring and research
- Academic and research purposes
3.2 Prohibited Uses
You may not use our services for:
- Illegal activities or violation of applicable laws
- Spam, phishing, or malware distribution
- Unauthorized access to systems or networks
- Copyright infringement or intellectual property violations
- Fraudulent activities or scams
- Harassment or harmful content distribution
- DDoS attacks or network abuse
4. Service Level Agreements
4.1 Uptime Guarantee
We guarantee 99.99% uptime for our proxy infrastructure. Service credits are provided for uptime below this threshold, calculated as a percentage of monthly fees.
4.2 Support Response Times
- Enterprise customers: Response within 1 hour for critical issues
- Professional customers: Response within 4 hours
- Standard customers: Response within 24 hours
4.3 Performance Guarantees
We guarantee 99.95% success rate for proxy connections. Performance issues are monitored continuously with automatic remediation.
5. Billing and Payment
5.1 Payment Terms
Services are billed in advance on a monthly or annual basis. Payment is due within 30 days of invoice date. Late payments may result in service suspension.
5.2 Usage-Based Pricing
Residential and mobile proxies are billed based on data usage (GB). ISP proxies are billed per IP address per month. Overage charges apply for usage exceeding plan limits.
5.3 Refunds
Services are non-refundable except for uptime SLA violations or our material breach of terms. Custom enterprise agreements may include different refund policies.
6. Data Privacy and Security
6.1 Zero Personal Data Collection
Our proxy network operates with zero personal data collection. We do not store or process personal information from websites accessed through our proxies.
6.2 Encryption
All proxy connections use TLS 1.3 encryption. Data in transit and at rest is fully encrypted using industry-standard protocols.
6.3 Compliance
We maintain SOC 2 Type II compliance and adhere to GDPR, CCPA, and other privacy regulations. Regular security audits and penetration testing are conducted.
7. Intellectual Property
All rights to our proxy infrastructure, software, and technology remain with Netalis. You receive a limited, non-exclusive license to use our services for your business purposes. You may not reverse engineer, decompile, or redistribute our technology.
8. Limitation of Liability
Our liability is limited to the amount paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the maximum extent permitted by applicable law.
9. Service Suspension and Termination
9.1 Suspension
We may suspend services for non-payment, violation of terms, or security concerns. You will be notified in advance when possible.
9.2 Termination
Either party may terminate services with 30 days notice. Enterprise customers may have custom termination provisions in their agreements.
9.3 Data Retention
Upon termination, your data will be deleted within 90 days unless required for legal compliance.
10. Force Majeure
Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, wars, or government actions.
11. Governing Law
These terms are governed by the laws of Israel. Disputes will be resolved through binding arbitration in Tel Aviv, Israel.
12. Changes to Terms
We may update these terms with 30 days notice. Continued use of services constitutes acceptance of updated terms. Material changes will be communicated directly.
